Appeals

When you are convicted of a crime, you have a constitutional right to appeal both your conviction and your sentence. This means that the Indiana Court of Appeals will automatically look at your case and try to figure out if there were any errors that would mean reversing your conviction. This does not mean that you get a retrial or that you get to introduce new evidence. It does mean that if you think there wasn’t enough evidence to convict you, or that there was prosecutorial misconduct, or the judge let in evidence that should have been kept out, this is your chance to make that argument.

An appeal is a long process that mostly happens on paper, but that doesn’t make it any less important. A well-done appeal could mean the difference between staying convicted and being released from prison.
